NOIR YOGA LLC
TERMS OF SERVICE
Purchase, Membership & Studio Terms
These terms describe the purchase, membership, reservation, and attendance policies of Noir Yoga LLC (“Noir Yoga”). Please review them before purchasing or booking.
1. Studio Access
All memberships, class packs, drop-ins, and intro offers may be used at both locations:
Ralph Avenue: 109 Ralph Avenue, Brooklyn, NY 11221.
Fulton Street: 1586 Fulton Street, Brooklyn, NY 11213.
Participation is subject to class availability and the services included in your purchase. Check the location listed for your reservation before attending.
2. Introductory Offer
The $50 introductory offer provides seven days of unlimited classes, beginning on the purchase date.
The offer is available to new clients only and is limited to one purchase per person. Unused days do not carry over beyond the seven-day period.
3. Drop-Ins and Class Packs
Drop-in: Valid for 30 days from purchase.
5-class pack: Valid for 30 days from the first booking.
10-class pack: Valid for 90 days from the first booking.
Classes must be used within the applicable validity period. Unused credits expire at the end of that period, subject to any rights required by law.
Class packs cannot be shared. A completely unused class pack may be transferred to another person. Once a pack has been used, its remaining credits cannot be transferred.
4. Membership Commitments and Automatic Renewal
All monthly memberships have a three-month minimum commitment, subject to applicable statutory cancellation rights.
Monthly, six-month, and annual memberships automatically renew until canceled. Your selected plan determines the recurring price and billing interval disclosed at checkout and in your membership agreement.
Canceling an individual class reservation does not cancel your membership. Not attending classes does not cancel a membership or stop recurring billing.
5. Membership Cancellation
Noir Yoga’s standard cancellation policy requires 30 days’ notice, except where applicable law gives you an earlier cancellation right.
You may request cancellation through your WellnessLiving account or the WellnessLiving app. Cancellation notices may also be submitted by email, telephone, mail, or in person using the contact information below.
Charges properly due before the effective cancellation date remain payable, subject to applicable law. A cancellation request stops future renewals when it takes effect; it does not automatically create a refund for an earlier payment.
The minimum commitment and notice period do not limit statutory cancellation or refund rights.
6. Membership Pauses
Members may take one free pause per calendar year, lasting up to 30 days.
No pauses are permitted during the first three months of membership. Membership billing is suspended during an approved pause.
Contact Noir Yoga to arrange your pause and confirm its start and end dates. A pause does not cancel your membership.
7. Class Cancellations and No-Shows
Cancel your reservation at least 12 hours before the scheduled class start time to avoid a penalty.
For cancellations made less than 12 hours before class, or for a no-show:
The reserved class or class credit is forfeited.
A $10 penalty fee applies.
Unlimited members also incur the $10 fee for late cancellations and no-shows.
Canceling a reservation does not extend the expiration date of a drop-in, intro offer, or class pack.
If Noir Yoga cancels a class, your class credit is restored and no cancellation penalty is charged.
8. Arrival and Late Entry
Noir Yoga maintains a strict five-minute grace period after the scheduled start time.
Anyone arriving more than five minutes late will be refused entry. The reservation will be treated as a no-show, including forfeiture of the class or credit and the $10 penalty fee.
Please allow enough time to check in and prepare before class begins.
9. Age Requirements and Waivers
Adults ages 18 and older may attend independently.
Minors ages 12–17 may attend only when accompanied by a parent who participates in the class. Children under 12 may not attend.
Adult participants must complete the studio’s required waiver before participating. A parent must sign the waiver for a minor before the minor participates.
The studio’s separate waiver governs its stated participation and risk provisions, subject to applicable law.
10. Refunds
Purchases of memberships, class packs, drop-ins, and intro offers are final except where a refund is required by law.
This policy does not override statutory cancellation rights, required refunds, or other consumer protections.
11. Statutory Cancellation Rights
Where New York’s Health Club Services Act applies, its protections take precedence over conflicting studio policies.
These protections include cancellation within three business days after receiving the written contract; cancellation for qualifying disability, relocation, death, or discontinuance or substantial change of contracted services; and cancellation rights following monthly or annual renewal.
Qualifying cancellations receive the refunds and processing protections required by law. Reasonable supporting evidence may be requested where permitted.
Noir Yoga’s three-month minimum commitment, 30-day notice policy, and final-sale policy do not waive these rights. Required statutory notices must also appear in the applicable membership contract.
12. Merchandise and Other Purchases
These terms address studio services, memberships, reservations, and attendance. Merchandise, gift cards, and event-specific purchases may have additional terms disclosed with the item or at checkout.
Purchases through Noir Yoga’s separate online merchandise shop are subject to the terms presented by that shop.
